Italian Legislation

In order to be able to celebrate a wedding in Italy there are some procedures and documents that are often different from town to town and that may change at any moment. Different documents are requested for the various nationalities. Inside the website we will describe the main documents that must be presented by the couple of each nationality in order to have a civil ceremony.

According to article. nr.116 of the Italian Civil Code, the foreign citizens who wish to get married in Italy must present a "Nulla Osta" (certificate of non-impediment) to the Italian authorities.

We consequently advise you to contact the local authorities of the town where you want to celebrate your wedding, before getting the documents and planning the ceremony and the journey.

We wish to inform you that the arrangements of the documents in Italy, many times must be made by appointment and you have to go to the offices on precise days and at precise hours that are often in various places.
We want to inform you that the public offices are often very crowded with people and a long wait is required.

The documents obtained out of Italy have 3-6 months validity from the date of issue and must be translated into the Italian language and must be authenticated with stamps both in the original copy and the translation.

A woman cannot get married within 300 days from the date of divorce without any special permission released by the competent Italian authority; to get this permission it is necessary, first of all, a medical certification that states that the woman is not expecting a baby.

The Officer of the Civil State celebrates the civil ceremony in the presence of two witnesses and the interpreter.


DOCUMENTS FOR AMERICAN CITIZENS

  • Passport
  • Attested Affidavit
  • Nulla Osta
  • If already, previously married, demonstration of the wedding conclusion or the certificate of death or the final sentence of divorce.
  • If both partners are less than 18 years old, a written consent by the parents is required.
The certificate of birth and the one of divorce must be translated into Italian and with Authentication ("Apostille seal") by the authority of the state where this was made (Secretary of State's Notary Public); this authentication has the aim of permitting the official use in a foreign state. The translation into Italian of the above certificates must be authenticated by the Italian Consulate.

Attested Affidavit
It consists of a declaration relevant to the civil state of the couple (unmarried/bachelor, divorced, etc.) that is made at the Italian Consulate or the Italian Embassy in your country in the presence of witnesses (two or four according to the various Consulates); the document is released and must be delivered in Italy for the recording.

This declaration can be done directly in Italy before the wedding at the Tribunal Office instead of in the US; also in this case you must make an appointment a sufficient period of time before and present with two witnesses and the interpreter

"Nulla Osta"
This is a final declaration that is made in Italy at the US Consulate or Embassy. With the latter you declare there are no legal impediments to the wedding. After that the declaration is authenticated at the Prefecture of the town where the wedding will be celebrated.
After this, the documents must be presented to the Town Hall; here an appointment must be made to make the Promise of wedding (Declaration of Intention to Marry) in the presence of an interpreter, if necessary.

DOCUMENTS FOR ENGLISH CITIZENS

  • Passport
  • Certificate of birth that must have the names of both parents
  • Certificate of no impediment
  • Nulla Osta
  • If previously married, demonstration of the wedding conclusion or the certificate of death or the final sentence of divorce. (Divorce Decree Absolute)
If both partners are English, the banns must be made at the competent Registrar's Office in the U.K. After twenty-three days' publishing, the Registrar's Office releases a "Certificate of No Impediment" which must be taken to Italy.

The above documents must be presented at the British Consulate to get the "Nulla Osta". This can be done with correspondence through the Consulate or the Embassy.
After this, the documents must be presented to the Town Hall; here an appointment must be made to make the Promise of wedding (Declaration of Intention to Marry) in the presence of an interpreter, if necessary.


DOCUMENTS FOR CANADIAN CITIZENS

  • Valid Canadian passport
  • Proof of Canadian citizenship (Canadian Certificate of Birth, Certificate of Canadian Citizenship, Registration of Certificate of Birth abroad, Certificate of the maintaining of the Canadian Citizenship)
  • If both partners are less than 18 years old, a written consent by the parents is required.
  • If previously married, demonstration of the wedding conclusion or the certificate of death or the final sentence of divorce
  • Complete information on the couple (name and surname, father's name and unmarried mother's name, date and place of birth, residence)
  • Document issued by the competent authority, the Provincial Vital Statistic in Canada confirming that the wedding registration is published in their archives.
  • Nulla Osta
The Canadian Government does not release the Nulla Osta, but the Canadian Embassy, to help the Canadian citizens in arranging for the suitable documents, prepares a declaration containing the most important information. This declaration is accepted by the Italian authorities according to the Art. 116.

To get this document from the embassy, a Canadian citizen must personally show the Canadian Consulate and must fill in a form and declare to confirm that there are no impediments to the wedding.

The declaration released by the Consulate or Embassy must be authenticated by the petitioner at the Prefecture of the town where the wedding is celebrated. No publication is required if both partners are not Italian citizens and not resident in Italy.
After this, the documents must be presented to the Town Hall; here an appointment must be made to make the Promise of wedding (Declaration of Intention to Marry) in the presence of an interpreter, if necessary.
